1. Who prepares and files the contract?
China’s national online contract-signing and filing framework assigns the operational role according to transaction type. For new commercial housing, the developer handles online signing and filing when contracting with the buyer. For an existing home sold through a brokerage, the brokerage normally performs that operation. In a direct resale, the parties may file through an online service or transaction-office window. That distinction tells you who enters the buyer’s identity, price, unit and payment data—but not who should verify them. Before confirming the filing, compare the following:
- the buyer’s name, passport number and identity type;
- the building, unit, floor, property address and real estate unit identifier where available;
- the total price, deposit and staged-payment figures;
- the named receiving or supervision account;
- conditions for financing failure, rejected eligibility, failed registration and refunds;
- every supplemental agreement, which can materially alter the standard-form contract.
A new-build reservation agreement, a brokerage service agreement, the formal online sale contract and the eventual ownership registration perform different jobs. Treating them as interchangeable is one of the most consequential beginner errors.
2. Payment supervision: similar name, different protection
This is the most counterintuitive difference. A new-build pre-sale funds supervision account is designed around the developer’s project and controlled use of pre-sale receipts. It is not a personalized escrow account guaranteeing every contractual remedy available to one buyer. The practical question is whether the exact payment has entered the project account stated in the applicable contract and official payment instructions.
Resale transaction funds supervision is structured around a different risk: the seller should not receive the supervised price before the conditions for title transfer are satisfied. The parties, bank and local transaction system use the supervision agreement to define deposit, release and refund events. China has no single nationwide rule imposing an identical resale supervision arrangement in every municipality, so obtain the local written procedure before paying.
For eligible overseas individuals, the State Administration of Foreign Exchange’s 2025 reform permits banks in qualifying cases to process property-related foreign-exchange payment using a purchase contract or agreement before the buyer supplies the completed filing proof, which must be supplemented later. Before sending domestic or overseas funds, match the beneficiary name, bank, account number, project or transaction reference and refund mechanism against the contract and supervision agreement. Do not rely solely on a sales representative’s message, a broker’s personal account or a replacement QR code.
3. What must be checked before money is committed?
New-build checks follow the project
A new-build buyer is not checking an ordinary seller’s completed title. The investigation instead follows the project and unit: whether the property is authorized for pre-sale or recorded for completed sale, whether the unit is shown as available, what the contract says about delivery and area adjustment, and whether project-level land or construction encumbrances could affect completion or first registration.
Ask the developer to identify the documents and milestones that must exist before the buyer can receive an individual ownership certificate. Handover, key collection and occupation do not by themselves prove that the developer has completed the first-registration step needed for the buyer’s registration.
Resale checks follow the current register
For a resale, the current real estate register matters more than the appearance of the seller’s paper certificate. Under China’s real estate registration information inquiry rules, a prospective transaction party can apply, using the prescribed identity and transaction-intention materials, to inspect the categories of registration information available under the rules. These may include the property’s natural condition, co-ownership, mortgages, advance notices, objections, seizures and other disposal restrictions.
Run the check before committing substantial funds and confirm whether another check is needed immediately before transfer. The contract should allocate responsibility for an existing mortgage, a co-owner’s signature, a tenant or pre-emption issue, and any newly imposed seizure. Where the seller’s loan remains outstanding, obtain the bank’s written mortgage-release or locally available mortgage-transfer route instead of relying on a verbal promise.
4. Tax documentation takes separate routes
Tax systems distinguish an incremental-property filing from an existing-property filing. A new-build buyer’s file normally follows the developer’s contract, invoice and buyer-side deed-tax evidence. A resale file must connect both parties to the transaction and may require the seller’s earlier acquisition, invoice, tax and holding-period records in addition to the buyer’s deed-tax filing.
One nationwide reference point is the housing deed-tax incentive effective from December 1, 2024: qualifying first and second family homes of 140 square metres or less are taxed at the specified 1% rate, with different rates above that threshold. Eligibility, the taxable base and documentary proof must be confirmed with the competent tax authority; the authoritative terms are in the State Taxation Administration policy database.
The relevance to this workflow is documentary rather than merely mathematical. A resale seller’s missing historical records can hold up tax determination, while a foreign buyer’s translated marriage or family-status records may affect a household-housing declaration. 5. Filing is not ownership registration
Online contract filing records and regulates the transaction. Ownership changes through entry in the real estate register. China’s real estate registration framework distinguishes first registration, transfer registration, mortgage registration and other registration types.
For a new build, the developer must complete the relevant first registration before the buyer’s individual ownership transfer can ordinarily be completed. The buyer will generally need the final contract and filing data, invoice, tax evidence, identity documents, any valid authorization and the project documents supplied through the developer.
For a resale, the existing registered interest is transferred from seller to buyer. The parties or properly authorized representatives generally participate, while mortgage release, a locally supported “transfer with mortgage” arrangement, tax processing and the new mortgage may be coordinated around the transfer application.
The completion files also differ. New-build buyers should retain delivery notices, inspection or handover records, area-adjustment documents, invoices and maintenance-fund evidence. Resale buyers should retain the transfer result, possession handover, key record, utility and property-fee settlements, lease disposition and other agreed vacancy or household-registration obligations.
Where Chinese translation enters the workflow
“Certified translation” is a useful international search term, but it is not the name of one universally accepted Chinese property-document format. A receiving developer, brokerage, bank, tax office, registration institution or notary may instead request a Chinese translation, a translation bearing a company or translation seal, supporting corporate credentials, or a notarized translation.
Confirm the required format with each recipient before ordering. Do not assume that a self-prepared translation, an overseas certification statement or a notarized copy automatically satisfies a municipal system. Translation commonly affects four early document groups:
- Identity: passport biographical page, former passport and evidence connecting different names or document numbers.
- Civil status: marriage certificate, divorce judgment, name-change record or spouse-related consent material.

Choose one Chinese rendering of the buyer’s name before contract entry. Record how the translation treats spacing, surname order, previous names and passport changes. The same identity should then appear in the contract, bank file, tax declaration and registration application unless the receiving authority directs otherwise.
Timing, cost and scheduling reality
There is no reliable nationwide completion time or total cost for either route. New-build timing can be dominated by construction, acceptance, delivery and the developer’s first registration. Resale timing is more often affected by title checks, the seller’s outstanding mortgage, bank coordination, tax review and transfer registration.
Foreign documents create a separate clock: the recipient must confirm its translation format; civil records or powers of attorney may need authentication; originals may have to travel internationally; and an online identity system may not support every foreign document. Ask the municipality and bank whether the buyer must attend, whether an authenticated POA is accepted, whether an appointment is required and whether original documents are retained or merely inspected.
Do not mail irreplaceable originals until the named recipient confirms its delivery address and handling rule. Price estimates should separate translation, authentication or notarization, brokerage, legal review, banking, tax and registration charges instead of presenting one supposed “China property purchase fee.”
Recurring China-specific failure patterns
Chinese property-practitioner commentary and buyer discussion communities repeatedly focus on the same practical errors. These are experience signals, not substitutes for official rules:
- “The developer handles everything.” The developer may operate contract filing and prepare project documents, but the buyer still has to verify identity, tax, payment and individual registration data.
- “I saw the original title certificate.” A current register inquiry is still needed because later mortgages, seizures or objections may not be evident from the paper presented.
- “The contract is filed, so I own the home.” Filing and ownership registration are separate legal and administrative events.
- “Any company account is safe.” The beneficiary must match the contract and applicable supervision arrangement; a developer affiliate, broker or individual account is not an acceptable substitute merely because a salesperson supplied it.
- “Translation can wait until the title application.” By then, an inconsistent Chinese name may already exist in the contract, banking and tax records.

China has no single national list of translation companies approved for every property transaction. Select support according to the written requirement of the actual recipient.
