Builder Complaint in Uttar Pradesh: UP RERA, Consumer Commission, Police or Cybercrime?
A builder complaint in Uttar Pradesh can belong to several very different systems. Delayed possession may call for a UP RERA complaint, a negotiated settlement may fit conciliation, and a separate compensation claim may belong before the Adjudicating Officer. If a builder has ignored an existing order, the buyer normally needs execution—not a repeat complaint about the same non-compliance. A fake payment link or fraudulent UPI account is different again: it may require immediate cybercrime reporting.
The practical task is therefore not simply to “complain against the builder.” It is to identify the result you need, check the project’s current status, preserve the right evidence and use the forum that can actually provide that result.
Key Takeaways
- For possession, refund, delay interest or conveyance: UP RERA Form M is normally the first route to examine when the dispute falls within a registered or registrable real-estate project.
- For compensation: the current UP RERA filing workflow uses a separate Form N route before the Adjudicating Officer. Do not treat refund, interest and compensation as interchangeable labels.
- If the builder has not complied with an existing UP RERA order: use the execution process for that non-compliance. A genuinely new cause of action may need separate analysis.
- If money was sent through a fake account, payment link, QR code or online impersonation: contact 1930 promptly and use the cybercrime system. A normal RERA filing is not an emergency financial-fraud response.
Who This Guide Is For
This guide is for homebuyers, allottees, NRIs, OCIs and family representatives dealing with a builder, promoter, real-estate agent or project anywhere in Uttar Pradesh. It covers both NCR projects around Noida, Greater Noida and Ghaziabad and non-NCR projects handled through the state’s other routing arrangements.
It is most useful when the buyer is seeking possession, refund, delay interest, compensation, execution of an existing order or investigation of suspected fraud but cannot tell whether to start with UP RERA, conciliation, a Consumer Commission, Jansunwai, the police or the National Cyber Crime Reporting system.
The usual evidence packet includes an allotment letter, Agreement for Sale or Builder Buyer Agreement, payment receipts, promoter ledger, bank or loan records, brochure, emails or WhatsApp messages, possession or cancellation letters and any earlier complaint or order. Hindi and English are the main working languages. Urdu, mixed Hindi-English messages and foreign-language documents are more likely to require translation when an overseas buyer, foreign bank account or foreign power of attorney is involved.
Choose the Route by the Result You Need
| Your immediate problem | Result sought | Route to examine first | Common wrong turn |
|---|---|---|---|
| Delayed possession, refusal to register a conveyance, unjustified cancellation or failure to refund | Possession, refund, delay interest, registration or compliance | UP RERA Form M | Using a general government grievance as if it were a binding order |
| Separate loss or statutory compensation claim | Compensation adjudicated under the RERA framework | UP RERA Form N / Adjudicating Officer | Assuming every monetary request belongs in Form M |
| Builder is willing to negotiate | Voluntary settlement without full adjudication | UP RERA Conciliation Forum | Assuming conciliation can compel an unwilling party to settle |
| UP RERA has already made an order that has not been followed | Compliance, payment or recovery | UP RERA execution request and, where applicable, Recovery Certificate process | Filing the same dispute again instead of enforcing the order |
| Deficiency in service or unfair trade practice | Consumer remedies, including appropriate monetary relief | Consumer Commission through e-Jagriti; NCH may be tried first | Confusing the National Consumer Helpline with a Consumer Commission judgment |
| Government authority has failed to act | Administrative response, transfer or escalation | Jansunwai or the relevant authority’s grievance system | Using Jansunwai to demand a binding refund from a private builder |
| Forged documents, impersonation, multiple sale or dishonest inducement | Criminal investigation | Local police or the applicable UP Police reporting channel | Treating every contractual delay as criminal cheating |
| Fake online account, UPI payment, QR code or digital impersonation | Urgent reporting and possible interruption of fund movement | 1930 and the National Cyber Crime Reporting system | Waiting for a civil or RERA complaint to be processed |
Using UP RERA for a Builder Complaint in Uttar Pradesh
Form M: possession, refund, interest and compliance
The UP RERA eCourts system separates a standard complaint against a promoter or registered agent from a compensation complaint. Its public filing manual describes Form M as the complaint route before the Authority and presents relief choices including possession, refund, delay interest and registration of the conveyance.
The manual currently states a filing fee of ₹1,000. It also asks for detailed project, unit, payment and loan information rather than accepting a short narrative alone. Before paying, match the spelling of the allottee, promoter, project and unit number to the Agreement for Sale, Builder Buyer Agreement or allotment letter. A name or unit mismatch can affect both portal data and later document review.
The official UP RERA complaint manual lists booking forms, allotment letters, agreements, payment plans, receipts, account statements, brochures, possession documents, demand communications, loan sanction letters and tripartite agreements among the materials the portal may request or accept.
Form N: compensation is a separate route
The current portal and public filing manual use Form N for compensation matters before the Adjudicating Officer. The manual also states a ₹1,000 filing fee for this route. The distinction matters because a buyer may use refund, interest, damages and compensation conversationally even though the filing workflow does not treat them as the same remedy.
Start by writing one sentence that identifies the precise outcome: “I want possession and delay interest,” “I want to withdraw and obtain a refund,” or “I seek compensation for a separately documented loss.” If the requested relief appears to cross Form M and Form N boundaries, obtain advice before filing instead of duplicating the same facts and amount across proceedings.
Conciliation: useful only when settlement is realistic
Conciliation is not a faster judgment. It is a facilitated settlement process and depends on participation by the parties. It is most suitable when the builder is identifiable, willing to participate and capable of performing a practical agreement—for example, a revised possession schedule, payment plan, unit adjustment or negotiated refund.
Prepare for conciliation with the same discipline used for a formal complaint: a dated payment ledger, the contractual completion date, copies of prior proposals and a written settlement range. Do not accept vague wording such as “possession soon” or “refund subject to availability.” Dates, amounts, default consequences and responsibility for registration or charges should be explicit.
If no agreement is reached, return to the formal remedy that matches the relief. Conciliation should not be allowed to obscure a limitation period or delay an urgent fraud report.
An existing order changes the route
This is one of the most counterintuitive points in the Uttar Pradesh workflow: winning an order and receiving money are separate stages. UP RERA’s filing workflow asks whether an earlier order exists and directs users seeking compliance with that order toward execution.
Keep the final order, complaint number, payment calculations, proof of non-compliance and every part-payment record together. A monetary order may lead to a Recovery Certificate and district-level revenue recovery activity, but the timing of actual recovery depends on the promoter’s assets, compliance and the local execution process. There is no reliable statewide recovery-time average that should be promised.
Execution applies to non-compliance with the existing order. If later conduct creates a genuinely new cause of action, ask a qualified advocate whether a separate complaint is appropriate.
The Online Complaint Still Has a Paper Stage
UP RERA is not necessarily a paperless start-to-finish process. The current public manual says that after the filing is evaluated and objections are cleared, the complainant must print the complaint and supporting documents, self-attest every page, mail or submit the physical set and upload proof of delivery.
The manual identifies the Lucknow headquarters at Naveen Bhavan, Rajya Niyojan Sansthan, Kala Kankar House, Old Hyderabad, Lucknow 226007 and a Greater Noida regional office at H-169, Chitvan State Road, Gamma II. Because office and routing details can change, use the address displayed in the live dashboard or current manual at the time of dispatch.
Operationally, this creates four common failure points:
- Uploading a PDF but omitting the corresponding paper annexure;
- Signing only the complaint form instead of every required page;
- Using filenames with spaces or special characters that the portal rejects;
- Sending the packet without retaining and uploading delivery proof.
The manual applies different upload limits to different sections, including 2 MB and 5 MB limits. Scan for legibility, not merely minimum file size. A compressed agreement that makes stamps, dates or handwritten endorsements unreadable is not a useful evidence copy.
When the Consumer Route Makes More Sense
A Consumer Commission may be relevant where the case is framed around deficiency in service, unfair trade practice or other consumer remedies. Online case filing and management now run through e-Jagriti. The current national jurisdiction rules allocate original complaints according to the consideration paid: up to ₹50 lakh to a District Commission, above ₹50 lakh and up to ₹2 crore to a State Commission, and above ₹2 crore to the National Commission. The controlling text is available through the Department of Consumer Affairs jurisdiction notification.
The National Consumer Helpline is different. It is a pre-litigation grievance channel that can forward a complaint and seek a response, but it does not issue the same kind of binding adjudicatory order as a Consumer Commission.
Do not run overlapping proceedings casually. The same builder dispute can touch more than one statute, but the choice of forum affects requested relief, disclosures, evidence, appeals and execution. If a complaint is already pending elsewhere, disclose it accurately and obtain advice before starting another proceeding.
Government Grievances: What Jansunwai Can and Cannot Do
Jansunwai–Samadhan is designed for grievances involving Uttar Pradesh government departments and administrative handling. It can be useful when a development authority, registration office or other public body has failed to answer, transfer or act on a matter within its responsibility.
It is not a substitute for Form M, Form N or a Consumer Commission complaint against a private promoter. A Jansunwai acknowledgement may document that an administrative issue was raised, but it does not itself award possession, refund or compensation.
Similarly, the Anti-Bhu-Mafia route concerns illegal occupation and land-mafia complaints. It should not be used as a generic escalation label for ordinary construction delay or a disagreement over contractual charges.
Police Report or Cybercrime Complaint?
A failed promise is not automatically criminal fraud. Delayed completion, disputed charges or a later inability to refund may remain civil or regulatory problems. Police reporting becomes more relevant where the evidence indicates forged documents, impersonation, a knowingly false project identity, multiple sale of the same unit, diversion through a deceptive account or dishonest inducement from the beginning.
For online financial fraud, speed matters more than perfect drafting. The UP Police cybercrime guidance directs victims of online financial fraud to call 1930. Preserve the transaction ID, bank or wallet details, UPI ID, beneficiary account, debit message, QR code, website address, phone number and screenshots. Contact the bank as well as reporting the incident.
A cybercrime report does not replace a RERA or consumer claim for possession, refund or contractual relief. The same event may create separate criminal and civil consequences, but each system performs a different job.
Check for Unregistered, Abeyance or Insolvency Status
Before choosing a route, search the project and promoter on the live UP RERA portal. An unregistered project, a project marked in abeyance and a registered project with delayed possession present different procedural questions. “Abeyance” should not be casually treated as proof that every transaction is void; it signals a status requiring closer review of the missing or unverified project information.
Insolvency can change the route more dramatically. If a promoter or project appears in the portal’s NCLT or insolvency information, obtain advice before assuming that an ordinary complaint or Recovery Certificate will continue normally. A Corporate Insolvency Resolution Process and any applicable moratorium can affect pending proceedings and recovery options. Identify the appointed Insolvency Resolution Professional and confirm the applicable claim process promptly.
Build the Evidence Packet Before Filing
Organize evidence chronologically rather than uploading an unlabelled folder. A practical index is:
- Booking form and allotment letter;
- Agreement for Sale or Builder Buyer Agreement, with contractual completion and grace-period clauses marked;
- Payment schedule, receipts and promoter ledger;
- Bank disbursement and home-loan documents;
- Brochure, advertisement and saved project-page disclosures;
- Demand, cancellation, refund and possession communications;
- Emails, WhatsApp messages and call follow-up records;
- Site photographs, defect reports and OC/CC material where relevant;
- Prior complaint, order, settlement or execution documents;
- A one-page chronology connecting each event to an annexure.
Do not submit only favourable lines from a chat. Preserve surrounding messages, dates, participant identifiers and the original export where possible. Translation makes digital messages readable; it does not prove who controlled an account or whether a screenshot is complete.
CertOf covers the translation side of electronic evidence in more detail in its guides to certified translation of WhatsApp messages and Indian lawsuit translation of WhatsApp, email and screenshot evidence.
Where Certified Translation Fits
The public UP RERA filing manual does not state a blanket requirement to translate every Hindi document into English. Most local files already contain Hindi, English or both. Certified translation becomes important when a decision-maker or lawyer cannot reliably read material evidence, particularly in NRI and cross-border files.
Typical examples include a foreign power of attorney, overseas bank statement, remittance record, foreign civil-status certificate, non-English contract, Urdu document or foreign-language chat. The translation should cover the complete relied-upon document, including stamps, seals, handwritten notes, notarial wording and apostille or consular pages when they form part of the submitted packet.
In India, “certified translation” is a practical bridge term rather than a single nationwide sworn-translator status. A recipient may instead ask for a true English translation, translator declaration, notarized declaration or affidavit-backed translation. Confirm the requested form with the advocate or receiving forum before ordering notarization.
For the distinctions that apply beyond Uttar Pradesh, use the existing guides to certified, notarized and attested translation for Indian property purchases and true, notarized and affidavit-backed translations for Indian court documents. Overseas buyers should also review the order of steps in NRI property powers of attorney, apostille and translation.
Cost, Timing and Mailing Reality
- UP RERA filing: the current public manual states ₹1,000 for Form M and ₹1,000 for Form N. Treat these as separate procedural routes, not a combined filing package.
- Consumer proceedings: jurisdiction and fees depend on the applicable commission and consideration paid.
- Conciliation: cost is not the only consideration; participation by both sides and precise settlement wording matter more.
- Paper logistics: printing, self-attestation, tracked postage and proof-of-delivery upload can add time after online scrutiny.
- Translation: cost depends on readable page count, language, handwriting, tables and whether certification or revision support is required.
No responsible guide can promise a statewide average resolution or recovery time. Hearing schedules, objections, settlement cooperation, execution, insolvency and district-level recovery all create separate queues.
Commercial Translation and Evidence-Preparation Options
| Provider type | Useful for | What to verify | Boundary |
|---|---|---|---|
| CertOf online certified translation | Foreign POA, bank statements, civil records, correspondence, contracts and multilingual evidence packets | Target language, full-document scope, certification wording, page matching and revision instructions | Translation and formatting only; no RERA filing or legal representation |
| Uttar Pradesh-based legal translation office | Hindi-English or Urdu-English records where an advocate wants a locally executed declaration | Physical address, translator identity, complete-document policy, confidentiality and whether notarization is actually required | Local presence does not make a provider officially endorsed by UP RERA |
| Advocate-coordinated translator | Contested evidence, Form N, appeals or cases requiring an affidavit format selected by counsel | Who translates, who signs the declaration, correction process and separation of legal and translation fees | Useful for special cases; not automatically necessary for a straightforward Form M packet |
For digital delivery planning, compare PDF, Word and paper certified translations. If the packet is ready, use CertOf’s online certified-translation ordering guide or proceed to the secure upload portal below.

Common Uttar Pradesh Filing Pitfalls
- Choosing a portal before deciding whether the desired result is possession, refund, compensation, settlement, execution or investigation;
- Starting the same complaint again after an order instead of requesting execution;
- Assuming online submission eliminates the physical-copy stage;
- Failing to reconcile the payment total with receipts, bank records and the promoter ledger;
- Using a government grievance against a private builder when a binding adjudicatory remedy is required;
- Waiting to report an online payment fraud while collecting a perfect civil-case file;
- Translating only selected paragraphs and omitting stamps, annexures or authentication pages;
- Treating notarization as proof that a translation or source document is accurate;
- Ignoring insolvency status before pursuing ordinary recovery;
- Relying on a broker’s description of project registration instead of checking the official project record.
Frequently Asked Questions
Should I file a UP RERA complaint or go to the Consumer Commission?
Start with the relief and legal basis. UP RERA is the specialized route for promoter, project, possession, refund, delay-interest and compliance issues within its jurisdiction. A Consumer Commission addresses consumer-service and unfair-practice claims. If both appear relevant or another case is already pending, obtain advice before duplicating proceedings.
What is the difference between UP RERA Form M and Form N?
In the current filing workflow, Form M is the standard complaint route before the Authority, while Form N is the compensation route before the Adjudicating Officer. The official public manual currently lists a ₹1,000 filing fee for each.
My builder ignored a UP RERA refund order. Should I file again?
For non-compliance with that order, the normal next step is an execution request based on the existing complaint and order. Keep proof of non-payment, part payments and updated calculations ready. A later and genuinely different cause of action should be assessed separately.
Do I need to send paper copies after filing online?
The current UP RERA manual says that after objections are cleared, the complainant must print and self-attest the complaint and supporting documents, deliver the physical set and upload proof of delivery. Follow the instructions displayed in your live dashboard.
Can Jansunwai order a private builder to refund me?
Jansunwai is an administrative grievance system. It may route or escalate a complaint involving a government body, but it is not a substitute for a RERA or Consumer Commission order against a private promoter.
When should I call 1930 about a property transaction?
Call promptly when the problem involves online financial fraud, such as a fake broker account, fraudulent payment link, false QR code, account impersonation or unauthorized digital transaction. Ordinary construction delay is not, by itself, a cybercrime emergency.
What if the builder or project enters insolvency?
Check the promoter and project status on the UP RERA portal and identify any Insolvency Resolution Professional. An applicable insolvency moratorium may affect complaints or recovery, so obtain legal advice before continuing with an ordinary execution strategy.
Do Hindi documents need certified English translation for UP RERA?
Not automatically. The public filing manual does not prescribe a blanket English-translation requirement for every Hindi record. Translate when the receiving forum or representative cannot reliably use the source language, or when foreign-language evidence forms part of the case.
Can I use a translated WhatsApp screenshot as evidence?
A complete translation can make the conversation readable, but it does not establish authorship, completeness or electronic authenticity. Preserve the original export, surrounding context, dates, account details and source-device information where available.
Prepare the Translation After You Know the Route
CertOf can translate and certify foreign powers of attorney, bank statements, civil records, contracts, builder communications and digital-message evidence. We preserve page order and visible official markings and can revise terminology after your Indian advocate reviews the draft.
CertOf does not choose your legal forum, draft a UP RERA complaint, calculate compensation, file an FIR, represent you at conciliation or guarantee acceptance by a government body.
Upload the complete final document packet to CertOf, including annexures, seals, notarial pages and apostilles that will be submitted. Include any wording or format instruction supplied by your advocate or receiving authority.
