La Paz Bolivia Inheritance Tax: How Heirs Handle IDTGB and Formulario 01
La Paz Bolivia inheritance tax is administered at the departmental level through the Gobierno Autónomo Departamental de La Paz, commonly called GADLP. It is not the annual municipal property tax, and Formulario 01 should not be confused with a national tax form issued through Bolivia’s Servicio de Impuestos Nacionales.
For heirs, the practical challenge is coordinating a 90-day tax period, a relationship-based rate of 1%, 10% or 20%, the UATD assessment and payment process, and the records needed to connect each beneficiary to the deceased and the inherited property. Foreign-language records add another layer, but translation supports the tax file; it does not determine the heir’s legal classification or tax rate.
Key takeaways
- Use the correct authority: the departmental UATD handles IDTGB and Formulario 01. A municipal office may supply an earlier property-tax receipt, but it does not issue the departmental inheritance-tax form.
- Do not assume the clock began on the date of death: departmental rules and current GADLP guidance connect the 90-day period to the legally documented acceptance or establishment of the inheritance. Confirm which dated instrument controls your case.
- Relationship changes the rate dramatically: the departmental framework assigns 1% to ascendants, descendants and spouses; 10% to siblings and their descendants; and 20% to other collateral beneficiaries, legatees and donees.
- A convincing Formulario 01 is not proof of payment: verify the beneficiary, asset, assessment, official payment trail and UATD system record. GADLP has documented a falsified Formulario 01 that actually belonged to another person.
Who this guide is for
This guide is for spouses, children, parents, siblings, other relatives and legatees handling tax on registrable property situated in the Department of La Paz, including real estate, vehicles, shares or other registered rights. It is most relevant after a declaratoria de herederos has been issued or a will has been formally validated, but before the inherited asset is finally transferred or disposed of.
Typical readers include an heir living abroad, a family using a Bolivian representative under a poder, or someone who has received a pre-completed Formulario 01, payment account or discounted offer from a tramitador. A common property packet combines the succession instrument, beneficiary IDs, a power of attorney where applicable, the previous year’s municipal property-tax receipt and a Folio Real or Información Rápida.
Foreign records normally need to be usable in Spanish. Depending on where the documents originated, examples include English–Spanish, Portuguese–Spanish, Italian–Spanish, German–Spanish, French–Spanish or Chinese–Spanish. These are examples rather than a ranking of demand in La Paz. The usual problem is not the language pair itself; it is an incomplete chain involving authentication, untranslated Apostille pages, inconsistent names or missing reverse-side endorsements.
Important: This guide provides general information, not Bolivian legal or tax advice. UATD should confirm the current form, assessment basis, deadline calculation, payment destination and document requirements for the specific estate.
Which authority handles the tax?
| Authority | Role in an inheritance file | What it does not replace |
|---|---|---|
| GADLP and its departmental tax administration, UATD | Reviews the departmental tax file, determines the IDTGB amount, issues payment instructions and records the resulting Formulario 01 | The succession declaration, municipal property-tax administration or final property registration |
| Municipal government where the property is located | May issue or confirm the prior-year municipal property-tax receipt used in the supporting packet | GADLP’s IDTGB assessment and Formulario 01 |
| Servicio de Impuestos Nacionales | Administers national taxes and forms that may arise separately | The departmental Formulario 01 |
| Derechos Reales | Handles the later registration of inherited real estate and updates the Folio Real | Payment or assessment of IDTGB |
This division is counterintuitive: one inheritance may involve a municipal tax receipt, a departmental tax form and a national-tax question without those documents being interchangeable. If Formulario 430 is mentioned in your file, ask the responsible authority to explain its separate legal basis and sequence. Do not assume either form replaces the other.
For the broader succession, overseas-authority and property-registration sequence, use the separate guide to La Paz inheritance for overseas heirs. This reference focuses on IDTGB and Formulario 01.
La Paz Bolivia inheritance tax rates by relationship
In its official explanation of Ley Departamental No. 81, GADLP identifies the following relationship-based rates:
| Beneficiary category | Headline IDTGB rate | Practical evidence issue |
|---|---|---|
| Ascendants, descendants and spouse | 1% | Birth, marriage, adoption and identity records must establish the claimed relationship. |
| Siblings and their descendants | 10% | The file may need records connecting both family branches to the deceased. |
| Other collateral beneficiaries, legatees and donees | 20% | A will or other instrument must identify the beneficiary and the legal nature of the transfer. |
The surprising point is that 1% is not a general “family rate.” A sibling may fall within the 10% category, while a more remote relative or legatee may fall within the 20% category. Translation can make a foreign relationship record intelligible, but it cannot turn one legal category into another.
Cases involving adoption, representation of a predeceased heir, disputed marital status, step-relationships or inconsistent civil records deserve individual review. Ask UATD to identify the legal category and taxable interest it applied before paying an amount you believe is incorrect.
When does the 90-day IDTGB period begin?
Decreto Departamental No. 90 associates the inheritance-tax period with the instrument establishing the heirs or validating a will, rather than treating the date of death as the automatic starting point. Separately, GADLP’s April 2025 guidance describes payment as due within 90 days after acceptance of the inheritance.
Those descriptions may point to the same document in a straightforward notarial case. They should not be treated as interchangeable, however, when the declaratoria, public instrument, will-validation decision or corrective order carries a different date.
- Identify the date on the notarized or judicial instrument establishing the succession basis.
- List any later order validating the will or correcting the declaration.
- Ask UATD which document and date control the deadline in this estate.
- Keep the answer in writing or note the official, date and office that supplied it.
- Prepare foreign documents immediately rather than waiting for the final weeks.
Late handling may involve UFV value updates, interest or penalties. These are distinct concepts, not one fixed “late fee.” Obtain an itemized UATD calculation rather than relying on an intermediary’s percentage estimate.
How the Formulario 01 process works
The departmental framework describes an authority-led assessment and payment chain. Formulario 01 is therefore more than an ordinary blank form that an heir fills out independently.
- Establish the inheritance basis. Obtain the declaratoria de herederos or the instrument validating the will. This article does not cover contested succession or the complete notarial process.
- Build the asset and identity packet. Match the deceased, each beneficiary, the inherited share and the registered asset across the documents.
- Submit the packet for UATD review. The tax unit checks the applicable rate, taxable information and supporting records. It may request additional evidence.
- Review the proforma. Confirm the beneficiary, asset description, relationship category, rate, amount and payment instructions before transferring money.
- Pay through the channel named by UATD. Preserve the bank-generated receipt and proof identifying the government account and transaction.
- Return or transmit the payment evidence as instructed. UATD records the payment and generates the departmental form. Confirm the current paper or electronic format rather than relying on an older sample.
- Check the final Formulario 01. Compare names, identity numbers, asset data, amount and transaction references against the underlying file before using it for registration.
Local office and scheduling reality
GADLP’s 2025 guidance says UATD provides service in both La Paz and El Alto, but it does not publish the exact desk addresses or appointment rules in that notice. Confirm the current service point before travelling.
The GADLP central website publishes a general address at Calle Comercio at Ayacucho No. 1200, telephone numbers 2 204127 and 2 204340, and general hours of 08:30 to 16:30. These are central institutional details, not confirmation that Formulario 01 is handled at that address or throughout those hours.
No authoritative standard completion time or official average professional fee is published. The realistic schedule depends on document completeness, valuation questions, corrections and the separate payment step. The tax itself should be paid only through the instructions attached to the UATD assessment.
Supporting records to prepare
For inherited real property, the departmental framework identifies a core packet that commonly includes:
- the declaratoria de herederos, validated will or corresponding formal instrument;
- identity documents or passports for the beneficiaries;
- a valid power of attorney when a representative acts;
- the prior year’s municipal property-tax payment record;
- the Folio Real or Información Rápida for the property;
- documents showing the inherited interest and an accurate asset description;
- the UATD proforma and subsequent bank payment evidence; and
- any additional record requested to resolve identity, relationship, ownership or valuation questions.
Vehicles, shares and other registrable rights require asset-specific records. Ask for a written checklist rather than adapting the real-estate list by guesswork.
Before submitting scans, compare every spelling, identification number, registration number and ownership percentage. A translation of a land-registry extract is useful only if it preserves the exact entries that the reviewer needs to match.
Where certified translation fits into the IDTGB packet
In Bolivia, the natural instruction is usually traducción al castellano, traducción legalizada or an apostilled or legalized document accompanied by a Spanish translation. “Certified translation” is a useful English bridge term, but it is not necessarily the name of the exact authentication format required by UATD, the notary or Derechos Reales.
Foreign records may include death and birth certificates, marriage or name-change records, wills, probate orders, powers of attorney and corporate ownership documents. Whether each one must be presented to UATD depends on what the Bolivian succession instrument already proves.
Before ordering translation, obtain the receiving office’s instructions on Apostille, legalization, translator-signature authentication, originals and copies. If authentication is required, completing it before translation usually allows the Apostille or legalization page to be translated as part of the same packet. Bolivia’s Ministry of Foreign Affairs provides an official Apostille verification tool.
A complete translation should account for stamps, seals, marginal annotations, signatures, illegible text and reverse pages. Names should be transcribed consistently while preserving genuine differences rather than silently “correcting” the source.
For the conceptual difference between translation certification and notarization, see certified versus notarized translation. The broader Bolivian authentication sequence is summarized in the guide to Apostille, legalization and Spanish translation order; the receiving authority’s inheritance instructions still control.
Formulario 01 fraud checks
Formulario 01 is a demonstrated local fraud risk. In April 2025, GADLP reported that officials detected a falsified Formulario 01 during a property-related usucapión matter. The form was already registered to someone else, and the discrepancy was found by comparing it with the government system. Although that incident was not an inheritance case, it shows why visual appearance alone is insufficient. See the GADLP fraud report.
The same report stated that there had been 20 arrests for similar conduct since 2020 and that the reported incident was the fourth case handled and referred to prosecutors during 2025. These figures cover related tax and property procedures, not inheritance cases alone, and should not be interpreted as an inheritance-fraud rate.
Verify before paying
- Obtain the assessment or proforma through the UATD process, not from an unidentified intermediary.
- Check that the beneficiary, deceased person, asset and rate match your file.
- Confirm payment instructions directly with UATD when an account, QR code or recipient differs from earlier written guidance.
- Do not transfer departmental tax to a lawyer’s, relative’s or intermediary’s personal account merely because a discount is offered.
- Keep the original bank receipt and an electronic copy.
- Ask UATD to confirm that the payment and Formulario 01 appear in its system before relying on the form for registration.
- Reject any promise that a relationship category can be changed informally to obtain the 1% rate.
Do not assume there is a public online Formulario 01 verification service. A scanned form, stamp or serial number is not a substitute for direct UATD and bank-record verification.
Translation and professional-support options
These services have different roles. None should be treated as a government endorsement, and the receiving office should approve the required translation and authentication format before work begins.
| Commercial provider | Publicly verifiable signal | Best-fit role and limits |
|---|---|---|
| CertOf | Online document upload and digital translation delivery | Foreign death, relationship, identity, will, power-of-attorney and Apostille pages translated into Spanish with formatting and revision support. CertOf does not calculate IDTGB, issue Formulario 01, pay tax or act as a Bolivian lawyer. |
| Traductores United Bolivia | Publishes a La Paz address at Alto Auquisamaña, Calle Los Tajibos, telephone 77778832, and English–Spanish certified, legal and property-document services | A local quotation option. Ask in writing whether its translator-signature, legalization, original-delivery and revision arrangements match the specific UATD or notarial instruction. |
| Società Dante Alighieri, Comitato di La Paz | The Italian Embassy’s public translator page lists Av. 6 de Agosto 2575, Sopocachi, and telephone +591 71561603 while stating that listed professionals are independent | A language-specific inquiry for Italian documents. Inclusion on an embassy list is not acceptance by UATD and is not an embassy guarantee. |
For an online order, send every page together rather than separating the source document from its Apostille or reverse side. CertOf explains the upload and ordering process, typical turnaround considerations by document type, and its revision and service policy. Digital delivery does not by itself prove that a Bolivian office will waive paper, notarization or local authentication requirements.
Official and public resources
| Resource | Use it for | When to contact it |
|---|---|---|
| GADLP UATD / Área de Impuestos Departamentales | Current checklist, deadline trigger, tax classification, proforma, payment destination and Formulario 01 verification | Before paying, before travelling to a counter, or whenever two documents show different dates or names |
| Autoridad Regional de Impugnación Tributaria, La Paz | A Recurso de Alzada against an appealable final tax decision | Immediately after notification. The national government’s Recurso de Alzada requirements explain the appeal route. The applicable deadline is generally 20 days, so obtain current instructions promptly. |
| GADLP Transparency and Anti-Corruption channel | Reports concerning public-service irregularities, corruption or misconduct connected with the departmental administration | When the concern involves officials or the departmental service itself. Use the official GADLP complaint channel. |
| Fiscalía and FELCC | Suspected forgery, false payment instructions, impersonation or criminal fraud | Preserve the form, messages, receipts, payment details and identity information. Bolivia’s Fiscalía states that written and verbal complaints in La Paz can be registered through the Formulario Único de Denuncias used by the police and prosecution service. |
A disagreement over the amount is not automatically fraud, and an administrative complaint does not replace a time-sensitive tax appeal. Use the route that matches the problem.
Common La Paz IDTGB failure points
- Going to the wrong tax authority: the municipality supplies a supporting property-tax record, while GADLP handles IDTGB.
- Starting the 90-day calculation from an assumed date: identify the declaratoria, acceptance instrument or will-validation decision and obtain UATD confirmation.
- Budgeting for 1% without checking the relationship class: siblings and more remote beneficiaries face substantially different headline rates.
- Submitting an incomplete authenticated packet: a translated certificate may still be unusable if the required Apostille, legalization page or reverse endorsement was omitted.
- Hiding name differences in translation: unexplained discrepancies between passports, civil records and the Folio Real may prevent document matching rather than solve it.
- Trusting a form without a payment trail: the official fraud example demonstrates that even a plausible Formulario 01 may belong to another person.
Frequently asked questions
Is IDTGB paid to GADLP, the municipality or SIN?
The departmental inheritance tax and Formulario 01 are handled through GADLP’s tax administration. A municipality may provide the previous year’s property-tax receipt. SIN handles separate national-tax matters. Ask for written clarification if your packet includes both Formulario 01 and Formulario 430.
Can I download and complete Formulario 01 myself?
Do not treat it as an ordinary self-prepared form. The departmental procedure describes UATD review, calculation, a proforma, payment and official generation or registration of Formulario 01. Confirm the current paper or electronic workflow directly with UATD.
Does the 90-day period begin on the date of death?
Not automatically. Departmental materials connect the period to the legally documented inheritance or acceptance process rather than the date of death alone. Ask UATD which dated instrument controls your case.
What IDTGB rate applies to a child, spouse or sibling?
The published departmental rates are 1% for ascendants, descendants and spouses; 10% for siblings and their descendants; and 20% for other collateral beneficiaries, legatees and donees. Legal classification and the taxable base require case-specific confirmation.
Must foreign inheritance records be translated into Spanish?
If a foreign-language record is needed to prove death, relationship, identity, authority or ownership, obtain the receiving office’s current Spanish-translation instructions. Ask separately about Apostille or legalization, translator-signature authentication, originals and paper copies. Translate every required authentication page, seal and endorsement.
How can I verify a Formulario 01?
Compare it with the UATD proforma and bank receipt, then ask UATD to confirm the beneficiary, asset, amount and system record. Do not rely exclusively on appearance, a scan, a stamp or a number printed on the form.
What should I do if the UATD assessment is wrong?
First request the calculation and legal classification in writing. If UATD issues an appealable final act, the Recurso de Alzada generally has a strict 20-day period after notification. Contact ARIT La Paz promptly instead of waiting for an informal correction to consume the appeal window.
Prepare the foreign-document portion of your packet
If the IDTGB file includes foreign death, relationship, identity, will or power-of-attorney records, obtain the notary’s or UATD’s current Spanish-translation instructions first. Then upload the complete document set to CertOf, including Apostille or legalization certificates, stamps, attachments and reverse pages.
CertOf can provide document translation, an accuracy statement, layout support and revisions based on written feedback from the receiving professional. It cannot decide heirship, calculate or pay IDTGB, create or verify Formulario 01, represent an heir before GADLP, or guarantee acceptance by a Bolivian authority.
